These Terms of Service apply to the purchase and use of the software Sticky Maker Studio. The provider is the company listed in the imprint.
Sticky Maker Studio is locally usable Windows software designed to support the creation of AI-powered videos. The software assists in processing voiceovers, image prompts, generated images, and creating an MP4 video.
After purchase, the customer receives access to download the software. The software is installed and used locally on the customer's Windows PC. The customer is responsible for ensuring that their computer meets the technical requirements.
The customer creates and is responsible for their own content. This includes in particular voiceover, script, beats, image prompts, reference images, and other project files. Beats and image prompts are prepared by the customer themselves, either manually or using their own AI text program such as ChatGPT, Claude, Gemini, or similar services.
For certain functions, your own API keys from third-party providers may be required, for example from OpenAI, Claude, Gemini, Leonardo AI, or other providers. These API keys, costs, terms of use, and restrictions of the third-party providers are the responsibility of the customer.
If the customer wishes to use another AI provider, this can be individually integrated within the scope of the Custom Edition upon request, provided this is technically feasible.
The Standard Edition contains the described basic scope of the software. The Custom Edition may contain individual adjustments, such as the integration of other AI providers, custom prompts, or special workflows. The exact scope of the Custom Edition is agreed upon individually.
Sticky Maker Studio supports the customer in video creation. However, no specific success is guaranteed. In particular, we assume no guarantee for reach, clicks, revenue, ranking, monetization, or the activation and availability of YouTube channels.
The customer is responsible for ensuring that their created videos, texts, images, prompts, and other content do not violate the rights of third parties and comply with applicable law and the rules of the platforms used.
We may further develop and improve Sticky Maker Studio. A claim to specific future functions only exists if these were expressly promised in the respective offer.
For digital products, the right of withdrawal may expire if the customer expressly agrees that the execution of the contract begins before the end of the withdrawal period, and confirms that they thereby lose their right of withdrawal. The specific cancellation policy is provided during the checkout process.
We are only liable for damages based on intentional or grossly negligent behavior. We assume no liability for data loss, failures of third-party APIs, incorrect inputs by the customer, or decisions by platforms such as YouTube, as far as legally permissible.
The law of the Federal Republic of Germany applies. Should individual provisions of these Terms of Service be invalid, the validity of the remaining provisions shall remain unaffected.
